When you represent or act as point of contact for a company or sole trader Eoly Energy NV does business with, we acquire some of your personal data. This data can include, but is not limited to, your contact details (email address, phone number, work address, etc.) and identification data (name, surname, etc.). We only use this personal data in the context of our professional activities to help stay in contact and facilitate our cooperation. With your consent, we may also use your data to send you direct marketing communication, based on the legitimate interests of Eoly Energy NV. Should you no longer wish to receive such communication, you may opt out at any time by clicking on the unsubscribe link in any of the emails you have received. We delete your personal data as soon as it is no longer relevant in the framework of our professional cooperation, for example upon being informed that you have left the company or sole trader you represented or acted for as a point of contact, or when said entity is no longer in business. Eoly Energy NV will never share your data with third parties. You have the right to access, correct, erase or transfer your personal data, and to limit or object to its processing. Eoly Cooperative Privacy Statement

1. General

This statement was written by Eoly Cooperative CV, with registered office at Edingensesteenweg 196, 1500 Halle, Belgium and company registration number BE0647562496, hereafter referred to simply as ‘Eoly Cooperative’ or ‘we’. This privacy statement details how Eoly Cooperative collects and manages your personal data in its role as a data controller. For you to be able to join Eoly Cooperative as a member-owner, we are required to process some of your data, such as your name, email address and bank account number. If your shares were not purchased by you, rather bequeathed to you by a third party (e.g. as a donation), we are still required to process some of your personal data, such as your name and account number, as provided by the aforementioned third party. Some of your data is also processed for marketing purposes. We may, for example, send you emails containing our newsletter, updates regarding current projects or inform you of planned future projects. You can opt out of this marketing communication at any time.

2. What personal data do we collect and process?

We collect and process data you yourself have shared with us, along with data gathered from your visits to our website.

2.1 Data on member-owners

You become a member-owner by taking part in a round of capital fund-raising. The data we process in this context is data you submit when you register to take part in a round of capital fund-raising. This data includes, but is not limited to, your name, gender, preferred language, date of birth, address, contact details, bank account information and a valid email address.

2.2 Data on potential investors

Should you wish to be informed of new projects we are planning, you can share your email address with us. We will then use your email address to keep you informed of any future projects.

2.3 Data provided via the contact form

By filling in your personal data and sending us a question via our contact form, you give Eoly Cooperative permission to respond to you using the contact data you provided.

3. For what purposes and on which legal grounds do we process your personal data?

3.1 Data on member-owners

We are legally obligated to collect your data to enter you into our shareholder register as a member-owner of Eoly Cooperative and to register the number of shares you own. We also need your data to facilitate communication with you. We have a legal obligation to contact you to invite you to attend our General Assembly, for example. We also have a legitimate interest in using your data to send you direct marketing emails to keep you informed about any current or new projects we are working on. You can always object to the processing of your data for direct marketing purposes by clicking on the unsubscribe link that is included in all of our marketing emails.

3.2 Data on prospective investors and interested parties

We have a legitimate interest in using data on prospective investors and other parties interested in becoming a member-owner to inform them of new projects they can invest in.

3.3 Data we collect via our website

We collect technical data on all visitors to our website. This data includes, but is not necessarily limited to, visitors’ IP address, browser, device data and any external websites referring visitors to us. We also collect data on the ways in which visitors use our website. This gives us an insight into behavioural trends, such as when people visit our website, how they navigate specific pages, which links they tend to click on and when do they leave our website. Analysing this data helps us make our website more user-friendly. Cookies allow us to get a clearer picture of visitors’ behaviour by logging multiple visits to our website. A cookie is a piece of information your browser stores on our behalf and resubmits to us at a later time, for example when revisiting our website in the future. 3.4 Data acquired via the contact form

We use the data submitted via our contact form to respond to your question(s). We only use this data to respond to your question, based on our legitimate interest in doing so.

4. Who has access to your personal data?

To optimise the processing of your data, Eoly Cooperative may employ third-party service providers, who may subsequently require access to (some of) your data to fulfil their services. We may ask them to help us in safely storing your personal data or to deliver communications to your home, for example. All such parties are bound by this privacy statement and will never use your personal data for any purposes other than those described in this statement. Other actors such as law firms, debt collectors, bailiffs, insurance companies or banks may also gain access to some of your personal data if necessary for the purpose of assisting us with activities under context of managing a particular case or working on a specific project. In some cases, certain (government) agencies have the right to view or retrieve some of your personal data. We will, of course, comply with such requests. Eoly Cooperative will never sell your personal data.

5. Where do we store your personal data?

Your data is stored in Belgium.

6. For how long do we store your personal data?

We are legally obligated to store your data as a member-owner in our shareholder register, doing so for as long as is required by law. We also store your data as a prospective investor, thereby enabling us to inform you of the first two new projects we develop after you have registered. Following that period we erase your data. Data you share with us via our contact form is stored for as long as it is necessary for us to be able to respond to your question and offer you additional support.

7. How do we protect your personal data?

We safely store your shared personal data on servers that are located in controlled and secure environments and that are protected against unauthorised access, use or change. Notwithstanding these data protection efforts, you should be aware that sharing your personal data on the internet always entails a certain level of risk. As such, we can never fully guarantee the security and protection of your personal data.

8. What are your rights?

Under existing personal data protection legislation, you have several rights with regards to your personal data. To exercise any of these rights, you can contact us using the contact details provided at the end of this privacy statement. We are then obligated to verify your identity by requesting a signed copy of the front of your ID card. You can find an overview of your rights below You have the right to ask us which of your personal data we have stored and to correct, transfer or erase any of your data, all free of charge. You have the right to object to the processing of your personal data or request that its processing is limited, all free of charge. You have the right to transfer your data to another data controller. You can always object to the processing of your data for direct marketing purposes by clicking on the unsubscribe link that is included in all of our marketing emails. You can opt out of direct marketing communication sent to you via regular mail by contacting us using the contact details provided in article 9 of this privacy statement. Should our Legal department be unable to assist you, you can always contact the Belgian Data Protection Authority to submit your complaint.

As our operations expand and evolve, we may occasionally amend or edit this privacy statement if we deem this to be necessary. While we will endeavour to inform you of any updates, the ultimate responsibility of keeping track of any updates to this policy is yours. We consider your continued participation in our operations a tacit agreement to any changes to this privacy statement.
